Since January 15, 2018, the Prince William County Department of Development Services has handled building permitting and inspection inside the Town of Haymarket, but the town retains its own zoning authority — town zoning approval is required before a building permit application goes to the county. Properties in the surrounding unincorporated area skip the town step entirely and follow the standard county zoning-then-building sequence. In either case the county requires zoning approval before a building permit, using a full-size, to-scale house location survey plat with the surveyor's seal and signature; a building permit applies to any pool with more than 150 square feet of surface area or a depth of 24 inches or greater. The pool may sit in any yard area provided it holds the same setbacks required of the primary structure in that zoning district, and pool and deck must both be at least five feet from the dwelling.
